"Amicus Curiae" translates to "Friend of the Court."  An Amicus brief is the nonpartisan action of a non-party to aid the court in understanding the case.  In practice, these briefs are often filed as a friend of one of the parties.  The following are cases in which the Center for Medicare Advocacy has acted as a "Friend of the Court".

  • UHM v. Humana, Inc.
    No. 06-35672 (9th Cir.), case in progress for several years


    At issue in this case is whether the actions and inactions of a Medicare Part D plan, defendant Humana, in failing to enroll, and otherwise provide prescription drug coverage to, the plaintiff beneficiaries cannot be challenged under state law fraud and breach of contract causes of actions because the grievance procedures established in the Medicare Prescription Drug Improvement and Modernization Act of 2003 ("MMA") preempt those claims.
